1. About these terms

These Terms and Conditions govern your use of https://blackreckon.com and every sale we make through it. By placing an order, you accept these terms, so please read them carefully.

We may update these terms from time to time. The version in force is the one published when you place your order.

2. Eligibility to buy

By placing an order, you confirm that you are:

  • You are at least [18] years old or the age of majority in your country, whichever is higher.
  • You are legally permitted to buy and own the products you are ordering in your country and region.
  • The information you provide us is accurate.
  • You are not ordering on behalf of a sanctioned party or for a prohibited end use.

Some of our products are age-restricted or subject to ownership rules that vary by country. It is your responsibility to know and comply with the law in your country before ordering. We explain product-specific eligibility in section 7 and, where relevant, on the product page.

3. Products and descriptions

We describe our products as accurately as we can, drawing on manufacturer data and our own research.

  • Technical specifications, detection ranges, and images are provided in good faith and, for figures such as detection range, represent manufacturer test conditions rather than a guarantee of real-world performance.
  • Colors and appearance may vary slightly from images depending on your screen.
  • We may correct errors in descriptions, specifications, or pricing (see section 5).
  • Stock is not guaranteed until your order is confirmed and paid.

Nothing in this section reduces your statutory rights to receive goods that match their description and are of satisfactory quality.

4. Prices, VAT, and payment

Prices are shown in [euros (EUR)] and, for sales within the EU, include VAT at the applicable rate.

Sales outside the EU. For orders shipped outside the EU, sales may be zero-rated for EU VAT. However, you the buyer are responsible for any import duty, sales tax, customs charges, and handling fees levied by the destination country. These are not included in our price and are payable by you on or before delivery. We recommend checking your country’s import rules before ordering, as these charges can be significant.

Payment. We accept [PAYMENT METHODS: bank transfer, credit card, cryptocurrency, paypal]. Payment is taken at the time of order through our payment providers [e.g., Stripe, PayPal, Klarna]. We do not store your full card details (see our Privacy Policy).

Ownership. The goods remain our property until we have received payment in full.

5. Pricing and description errors

We work to keep prices and details accurate, but errors occasionally occur. If we discover an error in the price or description of something you have ordered:

  • We will contact you as soon as possible.
  • You may confirm the order at the correct price or cancel it.
  • If we cannot reach you, we may treat the order as cancelled and refund you in full.

We are not obliged to supply a product at an incorrect price, even after we have sent an order confirmation, where the error is genuine and obvious.

6. Orders and contract formation

  • When you place an order, we send an acknowledgement. This confirms we have received your order, but we have not accepted it.
  • The contract is formed when we send you a dispatch confirmation or complete the export and eligibility checks in section 7, whichever is later.
  • We may decline an order for reasons including the product is out of stock, we cannot verify your details, we cannot lawfully ship the product to your destination, payment fails, or we suspect fraud or a prohibited end use.
  • If we decline after payment, we refund you in full.

7. Regulated products, export controls and eligibility

This section is important. Please read it before ordering thermal, night-vision, or other regulated items.

Some of our products are legally controlled regarding who may buy them, where they may be sent, and how they may be used.

Thermal and night-vision optics. These are dual-use goods. Their sale, export, and ownership are regulated in many countries and, in some cases, prohibited or restricted to licensed users. By ordering, you confirm that:

  • You may lawfully own and use the device in your country and region.
  • You are not subject to any sanction or export restriction that would make the sale unlawful.
  • You will not re-export, transfer, or use the device in breach of applicable export-control law, including EU Regulation 2021/821 and, where relevant, US ITAR/EAR rules.
  • You are not acquiring the product for any prohibited military, proliferation, or end-use application.

We may need to carry out export-control and eligibility screening before we accept and ship an order. This can include verifying your identity, destination and intended use. We may delay, decline, or cancel any order that we cannot lawfully fulfil, and we will refund you in full if we do.

Your responsibility. We are not liable for your failure to comply with the laws of your country. If a device is lawfully sold by us but unlawful for you to import or own, that is your responsibility, and customs seizure or local penalties are not grounds for a refund beyond your statutory rights.

8. Delivery

  • We ship worldwide, subject to section 7 and to destinations we can lawfully serve.
  • At checkout, we show delivery times and costs as estimates, not guarantees.
  • Risk in the goods passes to you on delivery. For consumers, the transfer occurs when you or someone you nominate takes physical possession.
  • If circumstances beyond our control delay delivery, we will let you know as soon as we can. See section 11.

9. Cancellation, returns and refunds

If you are a consumer in the EU, you have a statutory 14-day right to cancel, alongside your rights if goods are faulty. These rights, how to use them, and the position for business customers and regulated goods are set out in full in our Refund and Returns Policy, which forms part of these terms.

10. Warranty

Many products carry a manufacturer warranty in addition to your statutory rights against us as sellers. Warranty terms vary by brand and are described on the product page or in our Refund and Returns Policy. A manufacturer warranty does not reduce your legal rights.

11. Our liability

These terms do not limit our liability where the law prohibits such limitations, including for death or personal injury caused by our negligence, for fraud, or for your non-excludable statutory rights as a consumer.

Subject to that:

  • We are liable for foreseeable loss and damage caused by us breaking this contract or failing to use reasonable care.
  • We are not liable for loss that was not foreseeable or for business losses where you are buying as a consumer.
  • We are not liable for your misuse of a product or for any use that breaches the law of your country, including unlawful hunting, surveillance, or breach of firearm, wildlife, or optics regulations. You are responsible for lawful use.
  • Detection-range and performance figures are manufacturer estimates; we are not liable for real-world performance differing from them.

12. Force majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including strikes, supply failures, carrier delays, customs actions, natural events, war, or changes in export-control or sanctions law. If such an event occurs, we will contact you and, where appropriate, offer to reschedule or refund.

13. Your use of our website

You may use our website for lawful purposes only. You must not misuse it, attempt to gain unauthorized access, introduce malicious code, or copy our content without permission. Our content, branding, and product photography are protected and may not be reused without our written consent.

14. Governing law and disputes

These terms are governed by German law. [For consumers: this does not deprive you of the mandatory consumer protections of your own country of residence.]

  • Consumers: You may bring disputes in the courts of your country of residence or ours, as the law allows.

EU online dispute resolution. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

15. General

  • If any part of these terms is found unenforceable, the rest continue to apply.
  • We may transfer our rights and obligations under these terms; this does not affect your rights.
  • No delay in enforcing these terms is a waiver of them.
  • These terms, with the documents they reference, are the entire agreement between us.

These Terms and Conditions should be read with our Privacy Policy, Refund and Returns Policy, [Shipping Policy], and [Impressum]. They do not affect your statutory rights as a consumer.
